2. Third party content

The content on Horse Talk Forums may include links to third party external sites. You agree that Sitewonders Limited and the appointed moderators cannot be held liable for the content, nature or reliability of any third party links.

3. Our right to remove content

Sitewonders Limited and the appointed Horse Talk Forums moderators reserve the right, at their sole discretion, to remove any content from the forums or to ban or restrict anyone from entering or using the forums without warning or liability.
 
4. Content of Private Messages

Sitewonders Limited and the appointed Horse Talk Forums moderators accept no responsibility in connection with or arising from content in Private Messages. Neither Sitewonders Limited nor the Horse Talk Forums moderators are able to see, censor or pre-moderate any Private Messages submitted by members through Horse Talk Forums’s Private Messaging functionality.
   
5. Indemnity

By submitting any content to Horse Talk Forums you agree to indemnify and hold harmless Sitewonders Limited and the appointed Horse Talk Forums moderators from all claims, costs and expenses (including legal expenses) arising out of any content posted or published by you.
   
6. Content ownership

By submitting any content to Horse Talk Forums you are granting Sitewonders Limited a perpetual royalty free non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-license the content in whole or in part and in form. This does not affect your moral rights in any way.
   
7. Content take-down process

Horse Talk Forums will endeavour to remove any content that is offensive, defamatory or libellous, upon being given notice of such content. The process for requesting the taking down of content is as follows:

Step 1 – Notify us

We will review the thread or post in question and determine whether it should be taken down. As 'innocent disseminators' of the content on this forum, our policy is to remove content only when there is a clear legal obligation for us to do so – we will defend our members' right to freedom of speech if we have sufficient reason to believe that content was posted in good faith, without malice and is the honestly held opinion of the author.

 
Step 2 – Pre-Action Protocol for Defamation

If you disagree with our judgement on the taking down of any thread or post and still wish it to be removed, you must follow the requirements of the Defamation Pre-Action Protocol. It is advisable to seek legal guidance on this.
